Terms of Service
By commissioning me, you (the client) confirm that you have read and agree to the terms below.General Terms(i) Commissions will be for personal, non-commercial use only, unless otherwise discussed with and agreed to by me before payment. Commercial work will have a separate fee.
(ii) For non-commercial works I reserve the right to include the commissioned artwork in my portfolio, post it to social media, and stream the creation process online.
Please discuss with me before payment if you would like the artwork to be kept private or purchase the copyright of the artwork.
(iii) All prices are in USD. Payment will be through email invoice using Stripe or Square. 50% payment upfront is required before I begin working, and 50% after the sketch is confirmed. The client can opt to pay 100% upfront if desired.
(iv) I will do up to 2 minor revisions for the sketch based on feedback. More than 2 minor revisions will incur a fee. Any major revisions (e.g. change camera angle, major change to pose) to the sketch will also incur an extra fee.
(v) Pricing will scale will complexity of subject and additional elements such as backgrounds and props.
(vi) You (the client) will not request or perform a charge-back.Cancellation and Refunds(i) I reserve the right to cancel a commission at any time.
(ii) If I cancel a commission, the client will be fully refunded.
(iii) For client-requested cancellations I will refund the 50% upfront payment if no work has been started yet.
(iv) No refund is available for artwork that has been started on.Communication(i) I will ask questions and send progress for your feedback to ensure quality and accuracy.
(ii) If the client does not respond to or send a requested payment within 5 business days (120 hours), I reserve the right to assume that a client-requested cancellation has occurred.Artwork Copyright & Usage(i) I retain my full and exclusive rights to the artwork as the artist. The client may not claim it as anyone else’s creation.
(ii) A full resolution .png file of the finished artwork will be given to the client for personal use only (or for reproduction or commercial use, if agreed upon). For other delivery formats (e.g. PSD file) please inquire before payment, as additional fees may incur.
(iii) Any progress snapshots or works-in-progress were sent to the client only to ensure quality of work; no permission is granted to use or redistribute them for any purpose.
(iv) The client may not heavily alter the artwork. Adding any text or filters, cropping it, and resizing it are okay. If alterations will be required due to the nature of the project, please inquire before payment.
(v) If reposting the artwork, please credit my twitter (@riukioki), email ([email protected]), or other messaging account. This includes artwork that heavily references or traced my own.
(vi) The client may not use the artwork or parts of the artwork in blockchain technology in any way, shape or form.
(vii) It is prohibited to use my artworks to contribute to AI learning or AI databases in any way, shape or form.Definition of Commercial UseCommercial use is any use that meets one or more of the following criteria:(i) involves an exchange of money, goods, or other consideration
(ii) promotes a business, service or product
(iii) where financial gain is sought or a result, directly or indirectly
